1. Acceptance of Terms

By downloading, installing, accessing, or using LumenHealth (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and LumenHealth LLC ("we," "our," or "us").

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting an updated version within the App. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

The App is a personal health tracking tool that allows you to:

  • Track medical conditions using ICD-11 medical classifications
  • Log and manage medications, including dosages and schedules
  • Record symptoms and symptom history
  • Monitor vital signs (blood pressure, heart rate, temperature, blood oxygen, respiratory rate)
  • Track weight and body measurements
  • Log mood, mental health notes, and mood triggers
  • View informational summaries about medical conditions from MedlinePlus and AI-generated sources
  • Export health data as a PDF summary for personal use or to share with healthcare providers
  • Participate in a Community where you can share experiences, ask questions, and support other users through posts, comments, and likes

3. Medical Disclaimer and Health Information

3.1 Not Medical Advice

THE APP DOES NOT PROVIDE MEDICAL ADVICE. All content provided through the App, including but not limited to condition summaries, health information from MedlinePlus, and AI-generated summaries from Anthropic's Claude API, is for informational and personal tracking purposes only. This content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

3.2 AI-Generated Content

The App uses artificial intelligence (Anthropic's Claude API) to generate condition summaries when information is not available from MedlinePlus. AI-generated content:

  • May contain inaccuracies, errors, or outdated information
  • Is not reviewed by medical professionals before being displayed
  • Should never be used as the basis for medical decisions
  • Is clearly labeled as AI-generated within the App
  • Is provided on an "as-is" basis without any warranty of accuracy or completeness

3.3 No Doctor-Patient Relationship

Use of the App does not create a doctor-patient relationship, therapist-client relationship, or any other healthcare provider relationship between you and LumenHealth LLC. The App is a personal tool, not a healthcare service.

3.4 Emergency Situations

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. Do not rely on this App in emergency situations. The App is not designed or intended for use in medical emergencies.

4. User Responsibilities

By using the App, you agree to:

  • Provide accurate health information for your own personal tracking purposes
  • Not use the App as a replacement for professional medical care
  • Consult with qualified healthcare professionals regarding any medical conditions, symptoms, or treatments
  • Keep your device and account credentials secure
  • Not use the App for any unlawful purpose
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App on behalf of another person without their explicit consent
  • Follow the Community Guidelines (Section 5) when using Community features
  • Not share another person's private health information in the Community without their consent
  • Comply with all applicable laws and regulations in your jurisdiction

5. Community Features and Guidelines

5.1 Overview

The App includes Community features that allow users to share experiences, ask questions, and interact with other LumenHealth users through posts, comments, and likes. Community participation is entirely optional. Your personal health tracking data is never automatically shared in the Community.

5.2 Anonymous Posting

You may choose to post anonymously in the Community. When posting anonymously, your display name, username, and profile photo are hidden from other users. However, anonymous posting does not mean untraceable. LumenHealth LLC retains your identity in connection with all posts, including anonymous ones, for the following purposes:

  • Enforcing these Terms and Community Guidelines
  • Responding to valid legal processes, including court orders and subpoenas
  • Protecting the safety of our users and the public
  • Investigating reports of abuse, harassment, or other violations

5.3 Community Guidelines — Prohibited Content

You agree not to post, comment, or share content in the Community that:

  • Presents personal opinions or anecdotal experiences as professional medical advice, diagnosis, or treatment recommendations
  • Promotes unverified treatments, cures, or medical misinformation that could endanger health
  • Contains hate speech, discrimination, racism, sexism, or hostility toward any individual or group
  • Harasses, bullies, threatens, intimidates, or targets another user
  • Shares another person's private health information, personal data, or identifying details without their explicit consent
  • Contains sexually explicit, violent, or graphic content
  • Promotes self-harm, suicide, eating disorders, or substance abuse
  • Is spam, advertising, solicitation, or promotional material
  • Impersonates another person or misrepresents your identity (other than using the anonymous posting feature)
  • Violates any applicable law or regulation
  • Infringes on any third party's intellectual property rights

5.4 Content Moderation and Enforcement

LumenHealth LLC reserves the right, but is not obligated, to monitor, review, and moderate Community content. If we determine that content violates these Terms or Community Guidelines, we may take one or more of the following actions at our sole discretion:

  • Remove or hide the offending content
  • Issue a warning to the user
  • Temporarily suspend the user's ability to post in the Community
  • Permanently ban the user from Community features
  • Suspend or terminate the user's account entirely in severe or repeated cases

We strive to enforce these guidelines fairly and consistently. However, we are not responsible for content posted by users before it is reviewed or reported.

5.5 Reporting

If you encounter content that violates these Community Guidelines, please report it using the reporting feature within the App or by contacting us at support@lumenhealth.app. We will review all reports and take appropriate action.

5.6 User-Generated Content License

You retain ownership of the content you post in the Community. However, by posting content, you grant LumenHealth LLC a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your content within the App and in connection with operating the Community features. This license exists solely to enable us to operate the Community — we will not sell your content or use it for advertising purposes.

You are solely responsible for the content you post. LumenHealth LLC does not endorse, verify, or guarantee the accuracy of any user-generated content in the Community.

5.7 Disclaimer Regarding Community Content

Community posts and comments are created by other users, not by LumenHealth LLC or medical professionals. User-generated content in the Community may contain inaccuracies, personal opinions, or information that is not applicable to your situation. Never make medical decisions based on community content. Always consult a qualified healthcare provider.

6. Account, Data, and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information and health data. By using the App, you consent to the practices described in the Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You retain ownership of the health data you enter into the App. By using certain features (such as AI condition summaries), you authorize us to transmit specific data to third-party services as described in the Privacy Policy.

7. Intellectual Property

The App, including its design, code, features, graphics, and content (excluding your personal health data and third-party medical content), is owned by LumenHealth LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Medical information retrieved from MedlinePlus is provided by the U.S. National Library of Medicine and is in the public domain. ICD-11 classification data is provided by the World Health Organization. AI-generated summaries are produced by Anthropic's Claude API. We do not claim ownership of third-party content.

8. Third-Party Services

The App integrates with the following third-party services. Your use of these services is subject to their respective terms:

  • Anthropic Claude API — for AI-generated condition summaries (anthropic.com/terms)
  • Google Firebase / Firestore — for data storage and authentication (firebase.google.com/terms)
  • WHO ICD-11 API — for medical condition classification data
  • MedlinePlus — for medical condition information
  • Expo — for app development framework services

We are not responsible for the availability, accuracy, or practices of third-party services. Third-party services may have their own terms, conditions, and privacy policies that you should review.

9. Disclaimers of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that: the App will be uninterrupted, error-free, or secure; any health information, AI-generated content, or user-generated community content is accurate, complete, or current; the App will meet your specific health tracking needs; or defects will be corrected in a timely manner. We do not endorse or verify the accuracy of any content posted by users in the Community.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMENHEALTH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF HEALTH INFORMATION, PERSONAL INJURY, OR ADVERSE HEALTH OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

In no event shall our total liability to you for all claims arising from or related to the App exceed the amount you paid to us for the App in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless LumenHealth LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the App; content you post in the Community; your violation of these Terms or Community Guidelines; your violation of any applicable law or regulation; any health decisions you make based on information provided by the App or by other users in the Community; or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the App or to specific features (including the Community) at any time, with or without cause, with or without notice. Violations of the Community Guidelines (Section 5) may result in suspension of Community access, or in severe or repeated cases, termination of your entire account. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately.

You may request deletion of your data at any time through the App or by contacting us at support@lumenhealth.app. Data deletion will be processed in accordance with our Privacy Policy and applicable law.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Aurora, Colorado in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and LumenHealth LLC regarding your use of the App. These Terms supersede any prior agreements, communications, or representations, whether oral or written, relating to the App.
